What you should know about Independent Police Conduct Authority
The Authority is a small, focused organisation dedicated to providing effective, independent oversight of Police. Under section 12 of the Independent Police Conduct Authority Act 1988, the Authority’s functions are to . This may include directing or actively overseeing the Police investigation, or reviewing or auditing the Police investigation once it is completed. The Authority’s powers in relation to complaints are set out in section 17 and section 19 of the Act. Under the Independent Police Conduct Authority Act 1988, when the Authority receives a complaint about Police it is required to notify the Police. The Independent Police Conduct Authority Act establishes the Authority and defines its overall role and powers.
Under the Crimes of Torture Act 1989, the Authority has responsibility for examining and reporting on the conditions of detention and treatment of detainees in New Zealand Police custody. The work done by the Authority also contributes to Police outcomes of Confident, safe and secure communities’ and Organisational development’, and Police values of integrity and professionalism as outlined in the annual Police Statement of Intent. Under the Independent Police Conduct Authority Act 1988, the Authority can have up to five members. The Independent Police Conduct Authority is an independent body set up by Parliament to keep watch over the Police.
The Authority is required by section of the Independent Police Conduct Authority Act 1988 to maintain secrecy in respect of complaints, and by section to conduct its investigations in private. The Independent Police Conduct Authority was established in November 2007, replacing the Police Complaints Authority. Through most of its life, the Police Complaints Authority comprised a single person with a small number of support staff conducting reviews of Police investigations. the Independent Police Conduct Authority Amendment Act 2007 , which changed the Authority’s name and made changes to the Authority’s powers.
In 1995 Judge Carruthers was appointed Principal Youth Court Judge and in 2001 he was appointed Chief District Court Judge, a position he held until his retirement in 2005. Independent civilian oversight provides assurance for both the Police and members of the public
